Welcome to the Hexagon Intergalactic store! In these terms, “we,” “us,” and “our” refer to Hexagon Intergalactic Oy. Hexagon Intergalactic operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). Hexagon Intergalactic is powered by Shopify, which enables us to provide the Services to you.

We have done our best to display as accurately as possible the information about our products and services in our online store. However, please note that product colors or appearance may differ from how they appear on your screen. We do not guarantee that the appearance or quality of any products or services you purchase will meet your expectations or match what is described or shown in the online store. Our products are handmade, and natural variations in color and size may occur.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time, and we may also limit the quantities of any products offered to any person or in any region or jurisdiction on a case-by-case basis.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase a product or service. Hexagon Intergalactic reserves the right to accept or reject your order for any reason, at our sole discretion. Your order is not accepted until Hexagon Intergalactic confirms acceptance. We must receive and process your payment before your order can be accepted.

Please review your order carefully before submitting it, as Hexagon Intergalactic may not be able to accommodate cancellation requests after an order has been accepted. If we do not accept an order, if we make changes to it, or if we cancel it, we will attempt to notify you by contacting you using the email address, billing address, or phone number you provided at the time of the order.

Purchases may be returned or exchanged only in accordance with our Return Policy.

You represent and warrant that your purchase is for your own personal or household use, and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed. The price will be stated in your order confirmation email. Unless otherwise stated, listed prices do not include taxes, shipping charges, handling fees, duties, or import fees.

Prices shown in our online store may differ from prices available in physical stores, online, or other third-party stores. From time to time, we may run promotions through the Services that affect pricing and that may be governed by separate terms in addition to these Terms. If there is a conflict between promotion terms and these Terms, the promotion terms will control.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address and your credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete; (ii) you are authorized to use the credit card for the purchase; (iii) your credit card company will honor the charges; and (iv) you will pay all charges incurred by you, including the listed prices, shipping and handling charges, and any applicable taxes.

SECTION 5 – SHIPMENTS AND DELIVERY

We are not responsible for delays in shipment or delivery. All delivery times are estimates and cannot be guaranteed. We are not responsible for delays caused by the carrier, customs procedures, or other events beyond our control. Title and risk of loss pass to you when we hand the products over to the shipping carrier.

The Services and all content included in the Services—including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos, and photos, and their design, selection, and arrangement—are owned by Hexagon Intergalactic, its affiliates, or its licensors, and are protected by United States and other countries’ patent, copyright, and intellectual property laws.

These Terms permit you to use the Services only for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, transmit, or create derivative works from any material in the Services without our prior written permission. Except as expressly stated herein, nothing in these Terms grants you any license or other rights, and nothing shall be construed as granting you any license or rights under any patent, trademark, copyright, or other intellectual property right of Hexagon Intergalactic, Shopify, or any third party. Unauthorized use of the Services may violate state, federal, or other intellectual property laws. Hexagon Intergalactic reserves all rights not expressly granted.

The Hexagon Intergalactic store name, logos, product and service names, designs, and slogans are trademarks of Hexagon Intergalactic or its affiliates or licensors. You must not use such trademarks without Hexagon Intergalactic’s prior written permission. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans displayed in the Services are trademarks of their respective owners.

As part of the Services, you may be given access to customer tools provided by third parties that we do not monitor and over which we have no control.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Hexagon Intergalactic uses Shopify’s services to provide the Services to you. However, for any purchases you make in our store, the contracting party is Hexagon Intergalactic. By using the Services, you agree that Shopify is not responsible for any aspect of transactions between you and Hexagon Intergalactic, including any injury, damage, or loss resulting from products or services purchased. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with the Hexagon Intergalactic store.

You warrant that your Feedback does not violate any third party’s rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You also agree that your Feedback will not contain defamatory or otherwise unlawful, abusive, or obscene material, or any computer virus or other malware that could in any way affect the operation of the Services or any related website. WE DO NOT WARRANT, REPRESENT, OR GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SECTION 16 – LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXAGON INTERGALACTIC, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SUBSIDIARIES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THE CORRESPONDING ENTITIES OF SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, CLAIMS, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Hexagon Intergalactic store, Shopify, and our subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, payable as a result of your (1) breach of these Terms of Service or the documents incorporated by reference, (2) violation of any law or the rights of a third party, or (3) use of the Services.

We will notify you of any indemnification claims, provided that failure to provide prompt notice will not relieve you of your obligations unless you are materially prejudiced. We may manage the defense and settlement of such a claim at your expense, including selecting counsel, but we will not settle any claim that requires you to assume any non-monetary obligations without your consent (which you may not unreasonably withhold). You will cooperate in the defense of indemnification claims, including by providing relevant documents.

SECTION 18 – SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service, and such determination shall not affect the validity and enforceability of any remaining provisions.

If we fail to enforce any right or provision of these Terms of Service, such failure shall not constitute a waiver of such right or provision.

These Terms of Service, together with any policies and operating rules posted by us on this site or in connection with the Service, constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 21 – GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the federal and state (or regional) courts of the jurisdiction where the Hexagon Intergalactic store’s headquarters is located, which is Finland. You and Hexagon Intergalactic consent to venue and personal jurisdiction in such courts.
